These terms apply to your use of the website geodiving.lv and to the services we offer. The website is operated by SIA “GSMD”, registration No. 40203514419, registered address Ikšķiles iela 2 – 2C, Ogre, Ogres nov., LV-5001, Latvia. By using the website or booking our services, you confirm that you have read and accept these terms.
2. Using the website
The information on the website is provided for information purposes. When using the website you agree not to use it for unlawful purposes, not to interfere with its operation, and not to scrape or copy its content for commercial purposes without our written permission.
3. Information on the website
We aim to keep course descriptions, prices and availability accurate and up to date. However, the information may change without prior notice and does not in itself constitute a binding offer. Photographs and videos are illustrative.
4. Our services
We offer diving training (GeoDiving Academy), underwater works, and underwater inspection with a remotely operated vehicle (ROV). The scope, price and schedule of each service are agreed individually or as described in the online shop listing.
6. Booking, cancellation and refunds
- A booking is confirmed once we have agreed a date and, where applicable, received payment or a deposit.
- If you cancel more than [TODO: e.g. 7] days before the activity, we will offer an alternative date or refund the amount paid. For later cancellations the following applies: [TODO: cancellation and refund terms].
- We may postpone or cancel a dive or course for safety reasons, including weather, water conditions, equipment failure or an insufficient number of participants. In that case we will offer an alternative date or refund the amount paid.
- Consumers who purchase a service under a distance contract have a 14-day right of withdrawal, except where the service has already been fully performed with your prior consent or where the service is to be provided on a specific date.
7. Health, fitness and safety
Diving involves inherent risks. Before taking part you must:
- complete the medical questionnaire honestly and, where indicated, provide a doctor’s statement;
- tell us about relevant medical conditions, medication you take and any previous incidents in the water;
- follow the instructions of the instructor or dive supervisor at all times;
- not dive under the influence of alcohol, drugs or medication that impairs judgement.
We may refuse or stop participation without a refund if these requirements are not met or if we consider that participation would not be safe.
8. Certification
On successful completion of a course, the certificate is issued by the relevant diving certification agency in accordance with its standards. Payment for a course does not in itself guarantee certification, which depends on meeting the requirements of the training standard.
9. Liability
We provide our services with professional care and in line with industry safety practice. To the extent permitted by law, we are not liable for indirect losses, loss of profit, or for damage arising from a failure to follow safety instructions or from a failure to disclose material information about your state of health. Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by our negligence. Your statutory consumer rights are not affected.
10. Intellectual property
All text, photographs, video, logos and the GEO SIDEMOUNT DIVING brand on the website belong to us or are used with permission. They may not be used for commercial purposes without our written consent.
11. Links to other websites
The website contains links to the geodivingshop.lv online shop, to social media profiles and to other external websites. We are not responsible for the content or privacy practices of those websites.
12. Personal data
How we handle personal data is described in our privacy policy.
13. Governing law and disputes
These terms are governed by the law of the Republic of Latvia. We aim to resolve any dispute through discussion in the first instance. If no agreement is reached, the dispute shall be settled by the courts of the Republic of Latvia. Consumers may also contact the Latvian Consumer Rights Protection Centre (www.ptac.gov.lv).
14. Changes to these terms
We may amend these terms. The version in force at the time your booking is confirmed applies to that booking.
